This order has been given by the court of Chief Justice Arun Bhansali and Justice Kshitij Shailendra on a PIL filed by Harikesh Bahadur Singh. The petition states that the Executive Council of BHU has not been formed from 2021.

The executive has the right to take decisions in other matters including making rules for the university, financial and appointment. The Executive Council also has the right to hear the appeal of the suspended employee. Due to the absence of the executive, the Vice Chancellor is taking all the decisions. This is contrary to the rules.

The registrar of BHU also wrote a letter to the Ministry of Education. However, the council has not yet been formed. It is alleged that the Vice Chancellor is not taking interest in the formation of the Executive Council. For the first time, the court sought information from the Central Government and BHU administration about the action being taken to form the Executive Council in December. The next hearing of the case will be held on 16 April.
